1. Terms
These Terms of Service (the “Terms”) and Privacy Policy and Refund Policy govern your use of all available Smart Technology Team Services and Apps (Smart Technology Team), so please read them carefully before using Smart Technology Team.
In this document, we use Smart Technology Team to refer all Apps & Services of Smart Technology Team including Dict Box, Translator Offline, Photo Translator, Translate Box, Screen Mirroring Z, Screen Recorder and other our apps on iOS App Store, Google Play Store and Huawei App Gallery.
By using Smart Technology Team, you agree to be bound by these Terms. If you don’t agree to these Terms, do not use Smart Technology Team. If you are using Smart Technology Team on behalf of an organization (such as your employer), you are agreeing to these Terms for that organization, and are indicating that you have the authority to bind that organization to these Terms. In that case, “you” and “your” will refer to that organization.
We may revise the Terms from time to time. Changes may be posted within our Apps, so please check that regularly.
2. Auto Renewing Subscriptions
a. Subscription Services
Certain Smart Technology Team Apps on the Apple App Store, Google Play Store and Huawei App Gallery will allow you to obtain the benefit of the application on a subscription basis. Payment for such a subscription (which may be for example daily, weekly, monthly or yearly) may be processed in the application, by third parties who act on our behalf or directly by the mobile platform owner (e.g. Apple, Google or Huawei). Free trial subscriptions may be cancelled at any point up to 24 hours before the expiry of the free trial (Apple) or at any time before the end of the trial period (Google/Huawei). You can cancel a subscription service at any time during the subscription period via the subscription settings in your iTunes, Android or Huawei account. The cancellation will take effect after the last day in the relevant subscription period. You can find further information on cancelling orders and any associated refunds on the website of the third party re-seller from whom you purchased the app (for example, the Apple App Store, the Google Play Store or the Huawei App Gallery).
b. Trial Periods
Certain of our subscription services on the Apple App Store, Google Play Store or the Huawei App Gallery may from time to time be offered for a fixed period of time on a free-trial basis. You are free to cancel a free-trial subscription at any time via the subscription setting in your iTunes, Android or Huawei account.
3. Your Information and Responsibilities
To use Smart Technology Team, you optionally can create an account, either via Smart Technology Team or through your account with a third-party service such as Google or Apple. In the latter case, your Smart Technology Team account will be created using the information you provided to that service, such as your name and email address and other personal information that your privacy settings on that service permit us to access.
You may use Smart Technology Team only if you are 13 years or older and are not barred from using Smart Technology Team under applicable law.
You are responsible for safeguarding the password that you use to access Smart Technology Team. You are responsible for any activity on your account, whether or not you authorized that activity. You should immediately notify Smart Technology Team of any unauthorized use of your account.
By using Smart Technology Team, you provide us with text, graphics, images and other information (“your content”). You retain full ownership to your content. Smart Technology Team does not claim any ownership rights to your content. However, you are also solely responsible for your content. You indicate that you own or have the necessary rights to all of your content, and that use of your content does not infringe, misappropriate or violate a third party’s intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.
4. Smart Technology Team Intellectual Property Rights
Smart Technology Team and its licensors exclusively own Smart Technology Team, including all associated intellectual property rights. You acknowledge that Smart Technology Team is protected by copyright, trademark, and other laws of Singapore, Vietnam, the United States and other foreign countries. You agree not to remove, alter or obscure any copyright, trademark, service mark or other proprietary rights or notices incorporated in or accompanying Smart Technology Team.
Smart Technology Team grants you a limited, non-exclusive, non-transferable license to view, copy, and display Smart Technology Team solely in connection with your permitted use of Smart Technology Team.
5. General Prohibitions
You agree not to do-or attempt to do-any of the following:
Probe, scan, or test the vulnerability of any Smart Technology Team system or network or breach any security or authentication measures;
Access, tamper with, or use non-public areas of Smart Technology Team, Smart Technology Team’s computer systems, or the technical delivery systems of Smart Technology Team’s providers;
Decipher, decompile, disassemble or reverse engineer any of the software used to provide Smart Technology Team;
Interfere with, or attempt to interfere with, the access of any user, host or network, including sending a virus, overloading, flooding, spamming, or mail-bombing Smart Technology Team
Access or search Smart Technology Team or download any intellectual property from Smart Technology Team through the use of any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) other than our publicly supported interfaces;
Plant malware or use Smart Technology Team to distribute malware;
Send any unsolicited communications, promotions, advertisements or spam;
Send altered, deceptive or false source-identifying information, including “spoofing” or “phishing”;
6. DMCA/Copyright Policy
We respect copyright law and expect you to do the same. It’s our policy to terminate those accounts that repeatedly infringe or are believed to be repeatedly infringing the rights of copyright holders. If you believe that an Smart Technology Team product infringes your copyright, please contact Smart Technology Team copyright agent at [email protected]
7. Termination
We may suspend Smart Technology Team or terminate your access to and use of Smart Technology Team, at our sole discretion, at any time and without notice to you. For example, we may suspend or terminate your use if you are not complying with these Terms, or use Smart Technology Team in any way that would cause us legal liability or disrupt others’ use of Smart Technology Team. If we suspend or terminate your use, we will try to let you know in advance and help you retrieve data, though there may be some cases (for example, repeatedly or flagrantly violating these Terms, a court order, or danger to other users) where we may suspend immediately. You may cancel your account at any time by sending an email to [email protected].
8. Warranty Disclaimers
Smart Technology Team OR OUR LICENSORS’ INTELLECTUAL PROPERTY ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT AND NON-INFRINGEMENT AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE MAKE NO WARRANTY THAT Smart Technology Team WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS OR RELIABILITY OF ANY OF OUR INTELLECTUAL PROPERTY.
9. Indemnity
You will indemnify and hold harmless Smart Technology Team and its officers, directors, employees and agents, from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of Smart Technology Team or our licensors’ intellectual property; (ii) your content; or (iii) your violation of these Terms.
10. Use of Third-party AI services
The AI Features in this App are powered by third-party AI services and products which are integrated to our App (“AI Service Providers”). We do not:
Develop, own or control the underlying image/content generation models;
Exercise control over their design, functionality, or training data.
All outputs generated through the AI Features are the result of automated processes governed by these external AI Service Providers and are not created, curated, reviewed, or moderated by us prior to being presented to user. Accordingly, we make no representations or warranties regarding the accuracy, appropriateness, legality, or reliability of any generated images/content.
11. Disclaimer of Affiliation
The app, including the AI Features, developers, and associated entities, is not affiliated with, endorsed by, or in any way officially connected to any individual, organiation, company, artist, brands or Intellectual Property holders referenced, explicitly or implicitly, through stylistic choices or thematic expressions or naming conventions (e.g., “anime style,” “pirate fantasy,” etc.).
All trademarks, copyrights, characters, and other proprietary content mentioned by such styles remain the sole property of their respective owners. Any reference made within the App’s outputs is intended solely for illustrative purposes and does not imply any formal association, sponsorship, or approval. The use of publicly recognizable themes or aesthetics is intended solely to facilitate creative expression and user engagement. Such usage shall not be construed as an assertion of rights over any third-party intellectual property, nor as any form of commercial exploitation thereof.
12. Ownership of Prompts and Outputs
You retain rights to your original prompts that you submit. However, the App and/or AI Service Providers may retain anonymized prompts or outputs for the purpose including, but not limited to, of quality assurance, and safety improvements or training of new or related AI models. You are granted a limited, non-exclusive, non-transferable license to use the images/content generated through the AI Features for personal, non-commercial use only and in strict compliance with the Terms and this Additional Terms For AI Features, unless otherwise expressly permitted in writing.
13. Prohibited Uses
You are solely responsible for the prompts that you submit and the images/contents that you generate through the AI Features. You may use the AI Features only for lawful purposes and in accordance with the Terms and this Additional Terms For AI Features. You agree not to use prompts or the generated images and contents:
To commercially redistribute, license, sell, rent, lease, transfer, assign or otherwise exploit the generated images contents or prompts without obtaining prior written authorization and any necessary rights from us;
In a manner that infringes upon the rights of others (including but not limited to copyright, trademark, and publicity rights), or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity;
To replicate or recreate characters, logos, artwork, or styles in a way that constitutes derivative works or direct copying of protected content; Imitates or attempts to recreate the likeness of any known figure, brand, or media property without proper rights;
To bypass or violate known restrictions related to copyrighted or trademarked materials.
To impersonate, defame, or mislead any user, person or entity;
To train or contribute to the development of other AI models or datasets;
In any manner that violates applicable laws and regulations, or platform policies (including but not limited to App Store and Google Play guidelines and our AI Service Providers);
To bypass, disable or interfere with any geographical, jurisdictional or technical restrictions.
14. Limitation of Liability
Except as otherwise prohibited by applicable law, you gree to indemnify and hold us and our officers, directors, employees, and agents harmless from and against any indirect, punitive, special, incidental, or consequential damage arising out of or in connection with Your use of images and contents generated by our AI Features, including, without limitation, claims by third parties for copyright or trademark infringement, any violation by You of applicable federal, state, or local laws, statutes, rules, or regulations, even if we has been advised of the possibility of such damages.
Except as otherwise prohibited by applicable law, if We are responsible for any liability, such liability shall be limited to the amount that You actually paid for the relevant products and/or services when using our AI Features. Under no circumstances shall we be liable for any consequential or punitive damages. Please note that certain jurisdictions do not permit the exclusion or limitation of punitive, incidental, or consequential damages; therefore, the foregoing limitation or exclusion may not apply to you.
15. Content Disputes and Access Suspension
We reserve the right to suspend or terminate your access to our AI Features at our sole discretion in the event of any actual or suspected violation of the Terms and this Additional Terms For AI Features whether detected by us or reported to us by any third parties. If you believe that any prompt and/or generated images/content or infringes your rights or the rights of others, please contact us at the address below. Your notification should include sufficient detail to identify the content in question and describe the nature of the alleged violation.
We will make reasonable efforts to cooperate with You in resolving the matter promptly and appropriately. However, any such action shall be subject to the limitations and exclusions of liability as set forth the Terms and Additional Terms For AI Features.
16. Modification of Terms
These Terms, including the Additional Terms For AI Features, may be updated or amended from time to time to reflect changes in applicable laws and regulations, technical, or operational requirements. Your continued use of the AI Features after such updates constitutes your acceptance of the revised Terms..
17. Limitation of Liability
NEITHER Smart Technology Team NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING Smart Technology Team, INCLUDING OUR LICENSORS, WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE OR THE COST OF SUBSTITUTE SERVICES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE Smart Technology Team OR OUR LICENSORS’ INTELLECTUAL PROPERTY, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT Smart Technology Team HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
IN NO EVENT WILL Smart Technology Team’S TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE Smart Technology Team OR TO ACCESS YOUR CONTENT EXCEED THE AMOUNTS YOU HAVE PAID TO Smart Technology Team FOR USE OF Smart Technology Team OR TWENTY DOLLARS ($20), IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATIONS TO Smart Technology Team, AS APPLICABLE. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN Smart Technology Team AND YOU.
